Terms of Service

1. Acceptance of Terms

By accessing and using Video Kit AI ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.

2. Description of Service

Video Kit AI is an AI-powered video processing platform that provides the following services:

  • Video compression and optimization
  • Video format conversion
  • AI-powered transcription
  • Subtitle generation and embedding
  • Smart clip detection and extraction
  • Video splitting and trimming
  • Video merging

Certain features are available to guest users without an account. Creating an account provides access to additional features, job history, and longer content retention.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account information up to date
  • Notify us immediately of any unauthorized access to your account
  • Not share your account credentials with others

4. Acceptable Use

You agree not to use the Service to:

  • Upload, process, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Violate any intellectual property rights or other proprietary rights of others
  • Upload content containing malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal purpose or in violation of any laws
  • Engage in any activity that could damage, disable, or impair the Service

5. Content Ownership

You retain all ownership rights to the content you upload to the Service. By uploading content, you grant us a limited license to process your content solely for the purpose of providing the Service. We do not claim any ownership rights to your content.

6. Data Storage and Retention

Uploaded videos and processed outputs are stored temporarily in secure cloud storage (AWS S3). Content retention varies by tier: Guest and Hourly Pass users have 24-hour retention; Pro subscribers have 7-day retention. You are responsible for downloading and backing up any content you wish to keep before the retention period expires.

AI transcription processing uses the OpenAI Whisper API. Audio extracted from your video is sent to OpenAI for transcription and is subject to OpenAI's Terms of Use.

7. Service Tiers, Pricing, and Limitations

The Service offers three access tiers:

  • Guest (No Account): 3 tasks per day, 100MB file upload limit, standard processing speed, outputs include a "VideoKit AI" watermark, 24-hour content retention, ad-supported experience
  • Hourly Pass ($1.99): A one-time purchase granting 1 hour of full access including unlimited tasks, 2GB uploads, 5x priority processing speed, no watermarks, and ad-free experience. The pass expires exactly 60 minutes after purchase.
  • Pro ($12.99/month): Unlimited tasks, 10GB file uploads, 5x priority processing speed, no watermarks, ad-free experience, batch processing, and 7-day content retention. Pro subscriptions include a 7-day free trial. You may cancel at any time.

We reserve the right to modify tier features and pricing with reasonable notice. Feature availability and limits are subject to fair use.

8. Payments and Billing

All payments are processed securely by Stripe. By purchasing a subscription or Hourly Pass, you agree to Stripe's Terms of Service.

  • Pro Subscriptions: Billed monthly at $12.99/month. The first 7 days are free. You may cancel at any time; access continues until the end of the current billing period.
  • Hourly Pass: A one-time payment of $1.99. Non-refundable once activated. The 60-minute access window begins immediately upon purchase.
  • Refunds: Pro subscription refunds are handled on a case-by-case basis. Contact support@videokit-ai.com for assistance.

9. Advertising

The Service displays advertisements via Google AdSense to guest (non-authenticated) users and users without an active Pro subscription or Hourly Pass. Pro subscribers and Hourly Pass holders do not see ads during their active access period. By using the Service as a guest or without an active subscription, you consent to the display of advertisements. Ad content is provided by third parties and we do not endorse or guarantee any products or services advertised.

10. Upload Limits and Fair Use

The Service imposes limits on file uploads and API usage to ensure fair access for all users:

  • Maximum upload file size: 100MB (Guest), 2GB (Hourly Pass), 10GB (Pro)
  • Daily task limit: 3 tasks per day for free-tier users; unlimited for Hourly Pass and Pro
  • Only supported video file formats and MIME types are accepted
  • API requests are rate-limited to prevent abuse
  • Authentication endpoints have stricter rate limits to protect account security

We reserve the right to adjust these limits at any time. Attempting to circumvent rate limits or upload restrictions may result in temporary or permanent suspension of access.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
